Please read these Terms of Service ("Terms") carefully before using the ASimpleAviationTool mobile application (the "App") operated by Kan Company ("we", "us", or "our").

1. Acceptance of Terms

By downloading, installing, or using ASimpleAviationTool, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

ASimpleAviationTool is a free aviation toolkit designed for pilots. The App provides:

  • Real-time METAR and TAF weather reports
  • NOTAM and SIGMET information
  • VOLMET and ATIS data
  • Airport information (runways, frequencies, coordinates) from the OurAirports database
  • Crosswind and headwind calculator
  • Holding pattern entry calculator
  • Fuel requirement calculator

The App is available as a one-time purchase through the Apple App Store. There are no subscriptions or recurring fees. All features are included in the single purchase.

3. Use of the App

3.1 Eligibility

You must be at least 13 years old to use ASimpleAviationTool. By using the App, you represent and warrant that you meet this age requirement.

3.2 User Responsibilities

You agree to:

  • Use the App only for lawful purposes
  • Not attempt to reverse engineer, decompile, or disassemble the App
  • Not use the App to violate any applicable laws or regulations
  • Not rely solely on the App for safety-critical flight decisions

3.3 Operational Safety Disclaimer

ASimpleAviationTool provides information for reference purposes only. Weather data, NOTAMs, and airport information retrieved by the App are sourced from third-party public APIs and may be delayed, incomplete, or inaccurate. You must verify all information through official channels before making any flight-related decisions. The App is not a substitute for official pre-flight briefings, ATC instructions, or certified navigation equipment.

3b. Purchase and Payment

One-Time Purchase

ASimpleAviationTool is sold as a one-time purchase through the Apple App Store. Upon completing your purchase, you are granted a non-exclusive, non-transferable licence to use the App on devices associated with your Apple ID, subject to the App Store Terms of Service.

Payment Processing

All payments are processed by Apple through the App Store. We do not process or store your payment information. By purchasing the App, you agree to Apple's payment terms and conditions.

Refunds

Refund requests are handled by Apple in accordance with their App Store refund policy. We do not issue refunds directly. To request a refund, contact Apple Support or visit reportaproblem.apple.com.

4. Third-Party Data

The App uses publicly available data from third-party sources:

  • OurAirports: Airport data is sourced from OurAirports (ourairports.com) under a Creative Commons CC0 licence. We make no warranty as to the accuracy or completeness of this data.
  • Aviation Weather APIs: Real-time weather data is retrieved from public aviation weather services. We are not responsible for the accuracy, timeliness, or availability of data provided by these services.

5. Intellectual Property

The App, including its design, features, and content, is protected by copyright, trademark, and other intellectual property laws. You may not:

  • Copy, modify, or distribute the App or its content
  • Use our trademarks or logos without permission
  • Reverse engineer or attempt to extract the source code

6. Data and Privacy

Your use of ASimpleAviationTool is also governed by our Privacy Policy. Please review it to understand how we handle information.

7. Disclaimer of Warranties

ASimpleAviationTool is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

  • The App will be uninterrupted or error-free
  • Weather data, NOTAMs, or airport information will be accurate, complete, or current
  • The App will meet your specific operational requirements
  • The App is suitable as a primary source for flight planning or navigation

8. Limitation of Liability

To the maximum extent permitted by applicable law, Kan Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:

  • Your use or inability to use the App
  • Reliance on any weather data, NOTAM, or airport information provided by the App
  • Any errors or omissions in third-party data accessed through the App
  • Any flight-related decisions made based on information from the App

9. Indemnification

You agree to indemnify and hold Kan Company harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the App or violation of these Terms.

10. Termination

We reserve the right to terminate or suspend your access to the App at any time for any reason, including if you breach these Terms. You may stop using the App at any time by uninstalling it.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the App after such changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of France.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kan Company regarding the use of ASimpleAviationTool.

15. Apple-Specific Terms

The following terms apply to users who download ASimpleAviationTool from the Apple App Store:

  • These Terms are between you and Kan Company, not Apple
  • Apple is not responsible for the App or its content
  • Apple has no obligation to provide support or maintenance for the App
  • Apple is not responsible for addressing any claims relating to the App
  • You must comply with applicable third-party terms when using the App
